Adelaide Family Law - Child Support

Parents have ongoing legal obligations to financially support children of the relationship following separation and the level of support required is usually determined with reference to the formula set out by the Child Support legislation.

Some families use the formula as a guide only and take a flexible and interests-based approach negotiating agreements based on ensuring the practical needs of the children are always met and sharing other financial requirements as much as possible to make sure children do not go without. Other families will stick to the formula and only accept or give what the legislation says they can or must.  Some families use the Child Support unit of the Department for Human Services to transfer child support monies, and other families have a private collection agreement.

Child Support matters usually impact minor children more, however there are certain instances where adult child maintenance is appropriate and legal advice should be sought if you are curious about this option.

Unless specifically raised by a client, Phoenix Family Law will usually identify this as a potential issue when discussing aspects of property settlement and/or parenting arrangements. Calculating and settling child support arrangements or disputes is a situation that is unique to each family, and getting a helping hand to guide you through the details can be invaluable.

It is potentially one of the most challenging and influential elements in the separation process and Phoenix Family Law can advise and support clients to understand their obligations and options when determining how best to resolve problems that arise on this matter.
